Rules of the website and provision of services via electronic means
§1
General provisions
1. According to Art. 8 Par. 8 point 1 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended). (Hereinafter referred to as the "Act"), the operator of the MarineWeather.eu website sets this Rules of provision of electronic services (hereinafter referred to as the "Rules").
2. These Rules sets out the principles and technical conditions for the provision of services electronically by MarineWeather.eu, in particular through the Web site available on the Internet at http://www.marineweather.eu/
3. Each User is obliged to observe the provisions of these Rules from the time of acting with the purpose of using the Services that require logging in (entering personal data), in particular to downloading the web site referred to in paragraph 2.
4. All information contained on the MarineWeather.eu website is published for information purposes only.
5. The data contained on the website is the property of MarineWeather.eu and is generally available.
6. Using the MarineWeather.eu website is tantamount to the acceptance of these Rules.
§ 2
Definitions
1. "Electronic service" means a service performed by MarineWeather.eu by sending and receiving data using IT systems for processing, including digital compression and storage, on an individual request of a User, without the presence of the parties, and the data is transmitted via public networks within the meaning of the Act of 21 July 2000 - Telecommunications Law (Journal of Laws No. 73, item 852 as amended).
2. "User" means any natural or legal person who uses the Services or in any other way - according to law - uses the website made accessible by MarineWeather.eu.
3. "Provider" means the service provider MarineWeahter.eu based at Różana 95, 59-700 Bolesławiec.
4. "IT system" means a set of co-operating IT equipment and software, which provides processing and storage, as well as sending and receiving data through telecommunication networks with the appropriate, for a given type of network, terminal equipment within the meaning of the Telecommunications Law.
§ 3
The types and extent of services provided by electronic means
1. MarineWeather.eu provides the following Services:
a. provision of weather forecast via text message and e-mail
b. weather warning services,
c. graphic visualization services and presentation of weather forecast
2. Services provided by MarineWeather.eu are provided free of charge or for a fee - depending on the type of Service.
§4
Registration
1. The condition for the provision of certain Services by MarineWeather.eu is correctly filled out registration form accessible at MarineWeather.eu website.
2. A User, when sending the registration form confirms that:
1. the provided data is complete and in accordance with the facts
2. data provided by the User does not infringe the rights of third parties
3. the User is familiar with the Rules and agrees to abide by it
3. MarineWeather.eu can refuse to create an account for a specific user, if it is suspected that they act contrary to the law, morality, violate personal rights of third parties or legitimate interests of MarineWeather.eu.
4. The User gets access to their account using their login and password. The User is obliged not to disclose their login and password to any third parties. The User is fully responsible for the damage caused by their disclosure.
§5
Terms of Service and use of the website
1. Technical requirements for the use of the services referred to in § 3. 1 are as follows:
1) Internet connection;
2) a Web browser capable of displaying hypetext (HTML) documents on a computer screen linked to the Internet through a network web service.
3) in some cases you need cookies support and session handling.
2. A User who is a natural person, by logging in, uses a service that requires giving personal data.
3. In the case of unauthorized use of the Service, that is in breach of these Rules or applicable regulations, the provider of MarineWeather.eu service will have the right to process personal information to the extent necessary to determine the responsibility of the User. MarineWeather.eu will notify the User of illegal activities with the request to stop them immediately, and of the processing of personal data for the afore-mentioned purpose.
4. The Services are provided free of charge in the testing phase, hence MarineWeather.eu does not assume any responsibility for its operation.
5. It is forbidden to copy, publish, distribute and make available or use in any other manner all or part of the data contained on the MarineWeather.eu website for commercial purposes and by incorporating them in other websites (subject to provisions of paragraph 8.).
6. It is forbidden to repeatedly or systematically download elements from the MarineWeather.eu website, that could cause damage to the site (subject to provisions of paragraph 8.)
7. Any unauthorized diffusion and dissemination and use of data and information, or parts thereof contained on the MarineWeather.eu website is allowed only with the written consent of MarineWeather.eu or the conclusion of a separate agreement.
8. In case of obtaining a written consent of MarineWeather.eu for the diffusion and dissemination and the use of data and information, it is possible to use them in accordance with the points outlined below:
1) information used will be presented in its entirety, without any changes,
2) all the used data, information, and work will refer to the PDŻ website;
3) dissemination and use of data, information, and work is permitted only with the indication of PDŻ as the source of information, it is also acceptable to use the PDŻ logo for this purpose, with the proviso that the PDŻ logo may not be changed in any way.
§6
Complaints procedure
1. Users have the right to file complaints on matters relating to the Service.
2. Complaints should be submitted in writing, by registered mail to the following address: MarineWeather.eu, Różana 95, 59-700 Boleslawiec or electronically sending them to: info@marineweather.eu
3. Properly filed complaint should contain at least the following data:
1. User identification (including his full name, postal address, telephone, e-mail);
2. description of the problem giving rise to the complaint.
4. Complaints will be dealt with in order of their filing.
5. MarineWeather.eu will make its best efforts so that complaints are dealt with within 30 days of receipt.
6. In case of failure to meet the deadline described in paragraph 5, MarineWeather.eu website is required to immediately notify the User stating the reason for the delay and the expected date of dealing with the complaint.
7. MarineWeather.eu shall immediately notify the complaining party by e-mail to the e-mail address specified in the complaint of the outcome of the complaint.
8. Complaints that do not contain the data referred to in § 6 item 3 shall not be considered.
§7
Processing and protection of personal data
1. MarineWeather.eu can process without the User's consent their personal data necessary to establish, shape content, change and termination of the Agreement, in particular:
1. first name and surname of the User;
2. address;
3. telephone number;
4. User's email address.
2. MarineWeather.eu may, without the User's permission, process other than the above data, if it is necessary due to the characteristics of the Service. This data will be marked as necessary to provide the Service.
3. MarineWeahter.eu can process operational data of the User, that is, data characterising the use of the Services by the Client, such as:
1. signs identifying the Client assigned based on the above data;
2. signs identifying the end of a telecommunications network or computer system that is used by the User;
3. information on the beginning, end, and the scope of each use of the Service;
4. information on using the Services by the Client.
4. After terminating the use of the Services by the Client, MarineWeather.eu will not process personal data as specified in § 7 item 1 of the Rules, with the exception of the data, which is:
1. necessary to confirm the provision of Service
2. necessary for the purpose of market research and the research of the behaviour and preferences of the users, with the intention of these results being used for the improvement of the quality of services provided by MarineWeather.eu, with the User's consent;
3. necessary to clarify the circumstances of the unauthorized use of the Service;
4. accepted for processing on the basis of other laws or agreements.
§8
Consent to the processing of user data
By using the Services, the User consents to the processing their personal data by the operator of the MarineWeather.eu website, to the extent necessary for the proper provision of those services.
§9
The principles of accountability and protection of intellectual property rights
1. If a User uses the Service in a manner inconsistent with these Rules, the provisions of agreements binding the User with MarineWeather.eu or any regulations in force, MarineWeahter.eu has the right to process the User's personal data to the extent necessary to determine the responsibility of the User.
2. Upon receipt by the MarineWeather.eu a notice of the unlawful nature of the stored data provided by the User, MarineWeather.eu can prevent access to the data in question. MarineWeather.eu shall not be held liable for any damages resulting from preventing access to the data.
3. MarineWeather.eu notes that in connection with the provision of Service, the User can not put in their account or materials, any content protected by intellectual property rights, in particular copyrighted songs, materials bearing trademarks. The User is obliged to observe the law of intellectual property. Any copying, modification, public performance of available content without the consent of MarineWeather.eu is prohibited, unless it results from separate agreements or mandatory provisions of law.
§10
Final Provisions
1. These Rules shall apply from 1 July 2012.
2. MarineWeather.eu has the right to unilaterally alter the terms of these Rules.
3. Amendments shall enter into force when a revised text of the Rules is placed on the Web site referred to in § 1 item 2

1. General provisions
1.1. These Terms of Service for the "Text for Weather" service (hereinafter referred to as Regulations) sets out the conditions of use of the service of providing news content to users via text message (hereinafter referred to as Service) by the MarineWeather.eu service operator based in Boleslawiec, Różana 95, 59-700 Bolesławiec.
1.2. Regulations have been developed, adopted and made available to the Users of the service in accordance with Art. 8 Par. 1 and 3 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item. 1204, as amended. ).
2. Text for weather.
2.1. The Service is provided by MarineWeather.eu through mobile digital phone GSM network of the User via a mobile phone equipped with a function to send and receive text messages.
2.2. Text services are provided free of charge.
2.3. While using he Service, the User, via a mobile phone, has the ability to query the MarineWeather.eu system about weather. In response to a properly framed request, the User will receive a response from the system.
2.4. The fee for sending a text request is charged by the mobile network operator in which the User's mobile phone operates, on the terms specified by the operator.
2.5. MarineWeather.eu is not responsible for incorrectly formulated queries.
2.6. MarineWeather.eu reserves the right to make changes, partial or total suspension of the Service without notice to Users.
3. MarineWeather.eu liability
3.1. MarineWeather.eu shall not be held liable for the use of the Services by the User in a manner inconsistent with the Regulations.
3.2. Meteorological phenomena exhibiting high volatility, as well as limitations of forecasting techniques, give results that should be understood by the User as the most likely. MarineWeather.eu makes every effort to ensure that the information that is the subject of this Service is most relevant and reliable.
4. Personal data protection
4.1. The Users, at the moment of starting to use the Services, consent to the processing of personal data provided for the needs of provision of services by MarineWeather.eu.
4.2. The User has the right to access their personal data at any time and to correct them. At any time, the User may also revoke the consent to the processing of personal data via e-mail.
4.3. Personal data processing is done on the basis and in the manner prescribed by the law of 29 August 1997 on the protection of personal data (i.e. Journal of Laws of 2002 No. 101, item 926, as amended). All your information can be provided only to the competent judicial authorities and public authority authorized to have access to them on the basis of and within the provisions of applicable law.
4.4. The administrator of personal data is the provider of the MarineWeather.eu service.
4.5. Using the service is tantamount to the User giving their consent to be sent commercial information by means of communication systems by the operator, in accordance to the law from 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204, as amended)
5. Final Provisions.
5.1. The Service, as well as its individual elements are the property of MarineWeather.eu. It is forbidden to use the technology used to create the Service and distribute content provided through the Service in any way except personal usage, as permitted by the Regulations.
5.2. MarineWeather.eu reserves the right to change the Regulations at any time, without the need to inform the Users about the scope and content of the changes made. It is assumed that the date of entry into force of amendments to the Regulations is the date of providing the Users with a new version of the Regulations on the site.
Rules of use weather widgets
§ 1 General provisions
1.1.MarineWeather.eu portal allows Users to use the weather widgets service free of charge.
1.2.MarineWeather.eu provides widgets for non-commercial use only. Any other use of widgets requires a separate written agreement.
1.3.MarineWeather.eu offers its Users a choice of several types of widgets.
1.5. Weather data displayed in the Weather widgets are given in local time.
§2. Conditions of use
2.1. Users who use the weather widgets consent to the collection and processing by MarineWeather.eu the following data:

- type of browser the User uses
- other information transmitted by http protocol.
2.2.Users also agree to the MarineWeather.eu keeping cookies necessary for the proper provision of our services. These files do not collect personal information, do not change the configuration of the computer, are not used to install or uninstall any software, neither are they processed by other websites.
2.3. A User, wanting to put weather information widget on their site, enters the name of the city into the search box. Generated widgets with the selected city will appear on the site. To download the widget, click the 'get code' button. A new window will appear with the download code to be used on the website.
2.4. The service is supported by the following types of browsers: Internet Explorer version 7 to 9, Chrome, FireFox, Opera, Safari.
2.5. In addition, the Users who are using the Services are committed:

not to obstruct or interrupt the operation of the service, as well as all procedures and regulations arising from services provided by MarineWeather.eu.
- not to infringe, intentionally or unintentionally, any laws and regulations adopted and used in the country and abroad.
§3. Scope of liability
3.1.The information presented in widgets present forecasted data. Meteorological phenomena exhibit high volatility, there are also limitations in forecasting techniques. MarineWeather.eu makes every effort to ensure that the information that is the subject of this Service is most relevant and reliable.
3.2.MarineWeather.eu shall not be held liable for any damages resulting from:

improper operation of a User's website as a result of using the Service in a manner inconsistent with the Rules,
- interpretation and use of the information available on the Service,
- any loss caused by the use of weather widgets
- inability to use the Service, loss of data or loss of profits, arising from the malfunction of the Service.
3.3.MarineWeather.eu has the right to change these Rules at any time, without notice of the reasons and the scope of the changes. Amendments shall enter into force on the day they are published on the websites of MarineWeather.eu
